The extent of publication — a critical factor in the serious harm assessment — can therefore be vast, even for content originating from a private individual with a modest following.
  • Permanence. Online content, once published, can persist indefinitely. Search engines index and cache content, web archives preserve deleted pages, and screenshots circulate independently of the original publication. Content that was once easily forgotten now has a potentially permanent footprint.
  • Anonymity. The internet facilitates anonymous and pseudonymous publication to a degree that was impossible in print or broadcast media. While anonymity can protect legitimate whistleblowers and privacy, it is routinely exploited by those who wish to defame without consequence. Australian law provides robust mechanisms for piercing online anonymity.

Social Media Defamation

Social media platforms are the most common forum for online defamation in contemporary Australian practice. Each platform presents its own specific considerations:

Forum and Website Defamation

Reddit hosts numerous Australian-specific subreddits where defamatory content about individuals and businesses is posted. Reddit's pseudonymous structure and community moderation system can make voluntary removal difficult. Reddit's operators are US-based but have responded to Australian court orders.

Platform Liability

A critical and evolving question in online defamation is the extent to which platforms — as distinct from the original poster — can be held liable for defamatory content hosted on their services.

Section 32A of the Defamation Act 2005, introduced by the 2020 reforms, provides a conditional defence for digital intermediaries (platforms) that host or transmit content originating from third parties. To be eligible for the defence, a platform must: not have edited the matter; not have known, or ought reasonably to have known, that the matter was defamatory; and have complied with any applicable requirements under the Online Safety Act 2021 (Cth).

The defence is lost if the platform — having been put on notice that the content is defamatory — fails to take reasonable steps to remove it. The High Court's decision in Voller confirmed a broad conception of "publisher" under Australian law, and the combination of Voller and s 32A creates a strong incentive for platforms to respond promptly to defamation notices. A platform that ignores a takedown demand may find itself named as a co-defendant in subsequent proceedings.

Safe harbour provisions under the Broadcasting Services Act 1992 (Cth) — which previously provided significant protection for online platforms — were substantially amended by the Online Safety Act 2021. The current framework places greater responsibility on platforms to moderate harmful content.

Anonymous Publisher Identification

Identifying an anonymous or pseudonymous online publisher is one of the most common challenges in online defamation matters. Australian law provides several mechanisms:

Preliminary discovery under Rule 7.23 of the Federal Court Rules 2011 (Cth) (or equivalent provisions in State Supreme Courts) allows the court to order a platform or internet service provider to produce documents sufficient to identify an unknown respondent. The applicant must demonstrate that there is a reasonable cause to believe they may have a right to obtain relief against the unknown respondent and that, after reasonable enquiries, the respondent cannot be identified.

Norwich Pharmacal orders (available in State Supreme Courts) require a third party who has, without fault, become mixed up in the wrongdoing of another to provide information necessary to identify the wrongdoer.

The typical process involves: (1) obtaining account registration details and IP addresses from the platform; (2) cross-referencing IP addresses against internet service provider records through a subpoena; and (3) identifying the subscriber at the relevant IP address and time. This process is not always conclusive — VPNs and shared IP addresses can complicate identification — but it succeeds in a substantial proportion of matters.

Content Removal Strategies

Removing defamatory content from the internet requires a multi-layered approach. The appropriate strategy depends on the platform, the nature of the content, and how widely it has spread.

Direct platform reporting through the platform's complaints and reporting tools should be the first step. Major platforms maintain content moderation teams that respond to reports of defamatory, harmful, or policy-violating content. Results are variable — platforms apply their own policies, not Australian defamation law — but direct reporting is fast, free, and occasionally successful.

Formal legal demand. A demand letter from a specialist defamation lawyer, clearly identifying the defamatory content and asserting legal rights under Australian law, significantly increases the prospect of voluntary platform removal. The threat of platform liability under Voller and s 32A gives platforms a commercial incentive to remove clearly defamatory content promptly.

Court orders — including interlocutory injunctions and final injunctions — provide the most reliable mechanism for compelling removal of defamatory content. Australian courts will grant injunctions where the plaintiff can demonstrate a strong prima facie case of defamation, that damages would be an inadequate remedy, and that the balance of convenience favours removal.

Right to be forgotten considerations. The concept of a "right to be forgotten" — the right to have outdated, inaccurate, or harmful information delisted from search engines — is developing in Australia as part of the broader privacy law reform agenda. While not yet a clearly established right under Australian law, Google and other search engines have de-indexing processes that can reduce the visibility of defamatory content that has been removed at source.

Preserving Evidence

Evidence preservation is one of the most time-critical aspects of online defamation matters. Online content can be edited, deleted, or rendered inaccessible with a single click. Key steps include:

  • Screenshots — capture the defamatory content with the URL, date and time visible in the screenshot, and the full page context. Take screenshots immediately and regularly, as content can change without notice.
  • Web archives — use tools such as the Wayback Machine (web.archive.org) and archive.today to create permanent archived snapshots of the relevant pages. These archives are timestamped and can constitute important evidence of the content and extent of publication at a particular time.
  • Metadata — the metadata associated with a post (posting time, account details, engagement statistics, view counts) can be critical evidence in demonstrating the extent of publication and the identity of the poster. This data is more readily available at the time of publication than later.
  • Urgency. Social media platforms typically retain deleted content and associated metadata for limited periods (often 30–90 days). Google and other platforms retain IP logs and account data for varying periods. Delay in seeking legal advice can result in the permanent loss of identifying and evidentiary information.

Cross-Border Considerations

Online defamation frequently involves cross-border elements — content hosted on overseas servers, publishers located in other countries, and platforms incorporated in the United States. Australian defamation law applies to such publications, but enforcement can present practical challenges.

The High Court of Australia confirmed in Dow Jones & Company Inc v Gutnick [2002] HCA 56 that a defamatory publication occurs in the jurisdiction where it is downloaded and read. This means that a US-hosted website accessible to Australian readers publishes in Australia, and Australian courts have jurisdiction over the matter.

Australian courts have made orders against foreign defendants and foreign platforms in appropriate cases. The Federal Court and State Supreme Courts can serve process overseas under the Hague Convention and bilateral treaty arrangements. While enforcement of Australian judgments in the United States presents additional hurdles (US courts will not enforce foreign defamation judgments that are inconsistent with First Amendment principles), many online defamation matters are resolved without the need for foreign enforcement — particularly where the defendant has assets or a presence in Australia, or where the platform voluntarily complies with court orders.

The Single Publication Rule

Before the 2020 reforms, each new access to defamatory online content potentially constituted a fresh publication, resetting the limitation period. This created significant uncertainty — a defamatory webpage that remained accessible for years could theoretically generate a fresh cause of action on each occasion it was accessed.

Section 10AA of the Defamation Act 2005 (introduced by the 2020 reforms) addresses this by providing that, for the purposes of the one-year limitation period, a publication on the internet is to be treated as a single publication — the original date of posting — unless it is materially altered or re-published in a manner that brings it to the attention of new audiences. The single publication rule prevents claims from being commenced based solely on the continued online accessibility of old content.

Importantly, the single publication rule does not limit the damages recoverable — all harm caused by the ongoing publication remains compensable. It operates as a limitation rule only, not a substantive restriction on the cause of action.
